Online Healthcare Laws in India- Personal Data Protection Bill

After the accelerated adoption of the digital revolution in healthcare due to covid-19, the next step requires us to review where we stand on data privacy and security. Hence, comes into picture the Personal Data Protection Bill tabled in the parliament in 2019.

The bill classifies one’s health data under ‘sensitive personal information that needs to be protected against cyber threats. Thus, individuals’ consent will be required to access and store their data which will help in enhancing users’ trust and setting up a security framework that safeguards their right to privacy. In case of any violations, heavy penalties will be levied on the concerned parties by a Data Protection Authority (DPA). It is also being considered as part of the bill, to accord a unique Health ID for maintaining centralized health records and ensuring continuity of care. Once the law is in place, these frameworks will help enhance the system’s efficiency and ensure public welfare.
